Are you a Florida registered nurse who is working overtime hours?

The Fair Labor Standards Act (FLSA) provides an exemption from minimum wage and overtime pay for employees who are bona fide learned professional employees.

The exemption applies to nurses if ALL of the following tests are met:

1.  The nurse must be salaried or paid less than $455.00 perweek;

2.  The nurse’s primary duty must be work that requires advanced knowledge and consistent exercise of discretion and judgment;

3.  The nurse’s advanced knowledge must be in the field of science or learning and;

4.  The nurse’s advanced knowledge must be customarily acquired by a prolonged course of specialized intellectual instruction.

The Department of Labor has issued a fact sheet that says “registered nurses who are paid on an hourly basis should receive overtime pay. However, registered nurses who are registered by the appropriate State borad generally meet the duties requirments for the learned professional exemption if paid a salary of at least $455.00 per week.
