Florida Wage and Hour Law

With the exception of those lucky few that have won the lottery or have been born into great wealth, everyone has to work.

Some of us are fortunate enough to be in a position where we love what we do for a living, and some of us are not so lucky. But even for those of us that love our jobs, it is safe to say that our attitudes would change if we weren’t being fairly compensated for our labor.

Every day, Florida workers are taken advantage of by their employers. They don’t get paid for overtime, they are required to show up early or do extra tasks for which they aren’t compensated, or they get fired when they ask for leave to take care of a sick relative or to have a child. 

The Fair Labor Standards Act ( FLSA) is a federal laws that keep employers from taking advantage of their workers. But since most workers are worried about keeping their jobs so they can support themselves and their families, they are afraid  to rock the boat. They continue to work overtime without getting properly compensated, or keep their mouths shut when their paychecks seem light. You are legally entitled to the non-payment of your overtime. If your employer fires you. you have the right to sue for the non-payment of your last paycheck, your unpaid overtime or unpaid commissions, and sue for retailatory discharge.

Overtime: Federal law states that any work performed over 40 hours a week should be compensated at a rate of 1.5 times the hourly wage. Employees can be classified as "independent contractors" or "managers," or sometimes they are simply told that they are “exempt” from wage laws. According to the law, you are being paid for your work and not your title. Immigration: Many employees are afraid to bring up discrepancies in their pay due to their immigration status, but even undocumented laborers have wage rights.

"On Call" Status: If your employer expects you to be on stand-by in the event that you might be needed, you should be paid for your time even if you don’t get called in. The non-payment of on call is a common violation.
