Social Security Disability Reconsideration

At the initial claim level 70 percent of Social Security Disability claims are denied.

There are several reasons why a claim is denied at the request for reconsideration stage.

St. Petersburg, Florida Social Security lawyer Sharon Barrett explains that the Social Security Administration goes through a five-step sequential evaluation. At step three of the five-step sequential evaluation the Social Security Administration determines whether or not your condition falls within the definition of disability used by the Social Security Administration.

More often than not, we find that at the request for reconsideration stage the claim is denied for the following reasons: (1) the claims examiner determines that you have a non-severe impairment because your impairment does not meet the rigid definition of disability used by the Social Security Administration; (2) you have a condition that doesn’t meet the criteria for any one of the conditions in the impairment manual, which lists the approved criteria for physical and mental impairments; (3) your condition is severe but isn’t projected to last for 12 months; (4), you are considered to have the ability to return to the lightest job you did for the last 15 years; (5) you are considered to have the ability to perform other work.
