Are you a former employee of the Yellow Book who is insured under a Liberty Mutual disability policy? The date that you became disabled will determine your entitlement to disability benefits. Don’t destroy your long-term disability claim by filing a general release of employment claims. Did you know that you were terminated from your employment and asked to sign a general release of employment claims, you may unwittingly waive your right to a cover of benefits, under ERISA. This, of course, is State specific.

If you are offered a general release, you need to read it very closely and should strongly consider hiring an attorney to review the release. Language in that release that says “any and all claims can apply to all possible causes of action including ERISA claim for disability benefits”.

It is worth paying an attorney to review the release so you don’t unwittingly give up your rights to ERISA benefits. Nancy Cavey can help you review your files in order for you to make the right decision in order to help you with your disability benefits.

Long-term disability carriers don’t make it easy for you to get your disability benefits, and don’t make that worse by signing a severance agreement that destroys your right to future benefits. Consult ERISA disability attorney Nancy Cavey at 727-894-3188. The right ERISA disability attorney can make or break your case when it comes to disability claims.

A traditional method of treating coronary artery disease is prescribing beta blockers, ace inhibitors, statins and daily aspirin. A recent study, a described in the New York Times, shows that traditional treatment for coronary artery disease is just as effective as stent implantation for prevention of chest pain, heart attack and need for future percutaneous coronary intervention.

Percutaneous coronary intervention, or PCI, involves a surgeon inserting a mesh tube made of metal into an artery that has become narrow because of accumulated plaque. The tube is fed into an artery and expands to hold the artery open to the point that the blood flow is restricted. These stents are filled with medicine which helps keep the artery open.

However, Dr. Allen Schwartz, Chief of Cardiology at Columbia, commented that “cardiac disease is complicated, there are a lot of factors that go into assessing that go into who should and shouldn’t be treated with stenting.”

If you purchased a long term disability policy through your employer and you are applying for long term disability benefits as a result of coronary artery disease has been denied, you should contact long term disability attorney Nancy Cavey to learn more about your rights to long term disability benefits.

Did you know that the common practice of inserting a stent in to narrow artery has “no benefit over the standard medical care in treating of single coronary artery disease” according to a study, summarizing 8 random trials comparing percutaneous intervention and traditional methods of treatment.

In a percutaneous coronary intervention, a surgeon will insert a mesh tube made of metal into an artery that has become barrowed by accumulated plaque. The tube expands to hold the artery open, where the blood flow is restricted.

These stents are filled with medication that help keep the artery open. Despite the wide spread popularity of the procedure, many suggest that prescribing beta blockers, ace inhibitors, statin and daily aspirin were just as effective as stent implantation for the prevention of chest pain, heart attack or future PICI and death.

If your claim for Social Security Disability benefits has been denied and you have undergone stenting for coronary artery disease, you should contact coronary artery disease Social Security Disability attorney Nancy L. Cavey at 727.894.3188 for a complementary consultation to learn more about your rights to benefits.

One of the many questions that you are asked in the Social Security Disability claim process is what medication you are using.

Many people are unaware that pain killers, antihistamines, and various other medications can adversely effect brain functions. These drugs are called Anticholinergics can effect the action of Acetylcholine which is a chemical messenger with a range of functions in the body including memory function and cognitive function.

Anticholinergics drugs can be cumulative and, according the Journal of American Geriatrics Society, researchers found that “those taking more than one Anticholinergics drugs will have lower cognitive function than those that are not using any such drug.” The death rate among the study of users was 68% hire.

It is suspected that the Anticholinergics drugs take a “toll on the body organs and systems like cardiovascular systems adn although there are no studies to confirm this” according to Dr. Chris Fox, a Senior Lecturer at Norwich Medical School.

Statistics show that of 36 million Americans, 20% take at least one Anticholinergics medication.

According to Dr. Bostani, Director of the Wishard Healthy Aging Brain Center, if you are taking one of the drugs that is an Anticholinergics for 60 days, you double the odds of developing cognitive impairment. It’s important that in the course of your Social Security Disability claim that you advise the Social Security Administration whether or not you are having any cognitive effects as the result of any medication that you might be taking. This can make the difference between securing your Social Security Disability benefits or being denied those benefits.

If your claim for Social Security Disability benefits has been denied and your are taking multiple medications, you should contact us to learn how you too might get your Social Security Disability benefits. Contact us at 727.894.3188 for a no obligation consultation.

The Social Security Administration doesn’t make it easy to get your Social Security Disability benefits. In a recent study released by the Transactional Records Access Clearinghouse at Syracuse University, revealed “Why disparities in a percentages of claim’s granted by Administrative Law Judges with some judges within the same hearing office approving 90% of claims and others approving less than 15%”.

Social Security Administrative Law Judges decide Social Security Disability claims in regional hearing offices. Cases are assigned to judge’s randomly and you would think that the approval rate would be roughly the same. However, each judge has their own way of approaching disability cases and certain disability issues.

At our law office, we think that it’s crucial that your Social Security Disability attorney understand the judge’s personal “likes and dislikes”.

It’s just like your school days. You have to give the teacher what the teacher wants to get an A. You could improve your chances of winning your Social Security Disability claim by having a Pinellas County Social Security Disability Attorney, like Nancy Cavey. Contact your social security disability lawyer today at 727-894-3188 for a complimentary 30-minute consultation.

If you have a severe medical condition that makes it impossible for you to work and you have been denied your Social Security Disability benefits, Social Security Disability attorney Nancy Cavey can help cut through the red tape and fight for your benefits, no matter where you live in Pinellas County.

Before suing a long-term disability carrier, it is advisable to exhaust your appeal rights that are available under the Employee Retirement Income Security Act, (ERISA). If you purchased your group long-term disability policy through your employer, your case will be governed under the ERISA disability law which allows for a 180-day appeal period.

Nancy Cavey, ERISA long-term disability attorney, suggests that you get a copy of the long-term disability carrier’s file, including the adjusting notes, so you can see how they set your claim up for denial. It is important that you retain an experienced ERISA disability attorney to perfect an appeal that addresses point by point, blow by blow, every ground the carrier has raised to wrongfully deny your long-term disability benefits.

They may have had you have an Independent Medical Evaluation, a Functional Capacity Evaluation, or taken your statement in an effort to find a reason to justify their claims denial. There are specific strategies that can be employed to fight denial based on the carrier’s use of an Independent Medical Evaluation or vocational evaluation.

Many times long-term disability carriers will combine your statement with surveillance and try to trap you into admitting that you are capable of working or that you exaggerated your limitations.

Don’t be intimidated by the long-term disability carrier!

Once you have exhausted the 180-day appeal period, you may sue in Federal court if the long-term disability carrier has refused to reinstitute your benefits.

Many long-term disability carriers don’t make it easy to be civil to get the continued benefits you deserve. If a severe medical condition makes it impossible for you to work, and the long-term disability carrier has now denied your benefits after many years of making payments, ERISA disability attorney Nancy Cavey can help cut through the red tape and fight for your benefits, no matter where you live in the United States. Contact her today at 727-894-3188.

When you applied for long-term disability benefits, your carrier may have referred you to a company like ALLSUP to help you get your Social Security disability benefits. They also will ask you to do a direct deposit of any Social Security disability benefits to your bank account. But, guess what? The authorized agreement that you sign will allow for a one-time electronic withdrawal from your account. The money is then forwarded to the disability carrier. But, of course, that assumes that the calculation of any overpayment is correct.

While many long-term disability policies do require repayment of long-term disability benefits as a result of the receipt of Social Security benefits, mistakes can be made in the calculation of those benefits.

Nancy Cavey, long-term disability overpayment attorney, suggests that you don’t use a company like ALLSUP to help you with your Social Security disability claim because it is not uncommon for conditions to be developed, such as mental conditions that will allow the carrier to suspend your benefits after two years, despite the fact that you might have other medical conditions. And, worse yet, you are giving them the power to withdraw from your bank account the receipt of any Social Security disability benefits.

You owe it to yourself to make sure that any alleged overpayment that is calculated is in fact correct. The carrier will suggest to you that they will reduce your benefits by the receipt of any overpayment until it is recouped. While they certainly have the right to do so, you want to make sure that you only pay what is actually due and owing.

It depends on the terms of your policy! Many long-term disability carriers do provide that they have the right to reduce your benefits by the receipt of “other income”. ERISA disability attorney Nancy Cavey suggests that you first get out your long-term disability policy and review the terms of your policy to see whether or not there is a provision that allows for reduction of your benefits by the receipt of “other income”. Secondly, you should review the “other income” terms carefully to make sure that whatever benefits you might be receiving are in fact benefits that the carrier is legally entitled to offset.

Further, you should demand an explanation from the carrier that explains why they believe they have the right to offset your benefits and how they go about calculating any offset.

Don’t ever sign a reimbursement agreement that allows money to be electronically withdrawn from your savings or checking account. You deserve and should demand an explanation of any alleged overpayment before you agree to any repayment.

If your long-term disability benefits have been delayed or denied, private disability and ERISA disability attorney Nancy Cavey can help you cut through the red tape and fight for your benefits no matter where you live in the United States.

If you purchased long-term disability benefits and your doctor has told you that you are unable to work, you should file a long-term disability claim form.

There is no uniform … Read the rest

If you purchased long-term disability benefits and your doctor has told you that you are unable to work, you should file a long-term disability claim form.

There is no uniform disability form, but carriers like MetLife will use an individual disability claim and statement, individual long-term disability assessment, attending physician forms and behavioral assessment as part of the disability claims process.

If you have difficulty getting these forms from MetLife, or completing the same, you should contact MetLife denied long-term disability lawyer Nancy Cavey.

Nancy is never surprised when MetLife denies a long-term disability claim because carriers like MetLife are always looking for a reason to deny your long-term disability claim. The reasons for denial can start with how you have filled out your long-term disability application or what your physician says on the attending physician claim.

You should remember that MetLife went to the United States Supreme Court in the case of Metlife vs. Glenn arguing that they didn’t have any conflict of interest in making the claims determination when they were both the administrator of a long-term disability claim and the payer of a long-term disability claim. It sounds obvious that they would have a conflict of interest. If your claim is denied, it is crucial that you know how to accurately develop that conflict of interest so that you get the long-term disability benefits you are entitled to.

Attorney Cavey has written a number of must-do books about the long-term disability policies, and games that long-term disability carriers play.

MetLife claim disability attorney Nancy Cavey can help cut through the red tape and fight for your benefits no matter where you live in the United States. Contact her today at 727-894-3188.
