A: If you have a private disability insurance policy that you have purchased, you can sue in state court if the long term disability insurance company denies your claim. We file a bad faith claim with the Department of Insurance and, after that cliam period has expried, we generally file a state law suit.
If you have a group disability policy it is governed by a federal law called ERISA which requires you to exhaust all of your administrative remedies before you file a suit. There are no jury trials in an ERISA case unlike a state disability claim.
