  • Q: I have Blown the Sixty Day Period to File My Appeal Can I File it Late?

    A: Well, you have to have good cause for your late filing. The Social Security Administration will determine whether you have good cause for failure to file your appeal by considering:

    1.     Whether there were circumstances that interfered with your effort to pursue your claim.
    2.     Whether the Social Security Administrations actions confused or misled you.
    3.     Whether you understood the requirements of the Social Security act.
    4.     Whether or not your physical, mental, education or language abilities prevented you from filing a timely request for appeal, and understanding the need to file that timely request.

    Some examples of good cause can include:

    1.     That you were ill or hospitalized.
    2.     That there was a death or serious illness in your family.
    3.     That you didn’t understand the requirement to timely file or because of physical or mental problems you couldn’t file timely.
    4.     You never received notice of the denial because the Social Security Administration used the wrong address when you moved.
    5.     That you sent the appeal request to the wrong agency.
    6.     Unusual or unavoidable circumstances.
