Long Term Disability and Fibromyalgia Syndrome | Florida Fibromyalgia Disability Lawyer

    Fibromyalgia Syndrome and Long Term Disability Denials:

     Fibromyalgia is a syndrome because it describes a set of symptoms that occur without any disease-specific abnormalities in your body.  A Fibromyalgia sufferer has complaints of widespread pain, decreased pain threshold, difficulty sleeping, fatigue, stiffness, mood disturbance, irritable bowel syndrome, headache, and paresthesias.

    1) Work and Fibromyalgia Syndrome, a Consensus Report:
   There aren’t any definitive laboratory or diagnostic tests that will confirm Fibromyalgia.  However, in 1990 the American College of Rheumatology (ACR) established a criteria for the classification of Fibromyalgia Syndrome.  The criteria can include:

    1.) A 3-month history of widespread pain involving both sides of the body above and below the waist and in the skeletal axis.

    2.) Pain with palpitation of at least 11 of 18 designated bilateral tender points.
    Long term disability insurance companies hate Fibromyalgia Syndrome claims.  In fact, many long term disability insurance policies will have exclusions for Fibromyalgia or limit the amount of benefits that you can receive.  Why is that?  Because the diagnosis of Fibromyalgia is largely based on self-reported symptoms, many long term disability carriers just don’t think Fibromyalgia is a real disease. 

    If you can convince the long term disability carrier that your Fibromyalgia is real, more often than not they will deny your long term disability benefits on the basis that you are able to perform a sedentary or light job.  Under the trumps of most disability insurance policies you’re not entitled to disability benefits if you are able to work in a light or sedentary capacity.
