Social Security Is To Give GREAT Weight to VA Disability Ratings | Sarasota County Social Security Disability Attorney

If you are applying for Social Security Disability Benefits and that condition has been rated by the VA, the Social Security Administration must give GREAT weight to the VA disability rating.

In McCartey v. Massanari, 298 F.3d 1072 (9th Cir. 2002), the claimant had been found by the VA to be permanently totally disabled and unable to "secure and follow a substantially gainful occupation due to disability." The court reversed the ALJ rejection of the VA findings. If your disabiling condition has been rated by the VA, make sure you send Social Security a copy of the VA ratings decision. It could make all the difference in your case.
